LEASE CONTRACT
出租方(甲方)【Lessor (Party A)】: 承租方(乙方)【Lessee (Party B)】: 居间方:
甲、乙双方经过友好协商一致订立本合同,以资共同遵守。
【Having reached unanimity through friendly consultation and negotiation, Party A and
Party B, hereby agree to enter into the following Contract to be abided by both parties.】
一、建筑地址【Address of Premises】
甲方将其所有的位于上海市的
房屋在良好及可租用的状态下出租给乙方居住使用。
【Party A lets its lawfully owned premises to Party B in good and tenantable condition,
located at , Shanghai for living purpose.】
二、租赁期限【Lease Term】
租赁期自 日起至 日止,甲方应于起
租日之前将房屋交给乙方使用。
【The lease term shall be from to . Party A shall
vacate the premises and deliver it to Party B for use before lease inception】
三、定金【Earnest Money】
3.1 乙方应付的定金为人民币元整( 大写: ),自签约日起三日内
支付给甲方,租期开始之后,上述定金转为下述第五条的保证金。
【Party B should pay ¥ as an earnest money. The earnest money to be
paid to Party A within 3 days dating from signing the Contact; After the lease term begins,
the above-mentioned earnest money shall be automatically turned into deposit of security of
Clause 5 of this Contract.】
3.2 在甲方收到定金(以乙方汇出日为准)之后自租期开始之前如甲方违约,则上述定金由甲方
双倍返还乙方,如乙方违约则定金由甲方没收,且违约方须支付居间方等同于月租金数额的服务费。
【If Party A violates the Contract after receiving the deposit (depending on the date of remitting from Party B) and before the lease term begins, Party A shall pay double the earnest money back to Party B. If Party B violates the Contract, the earnest money shall be confiscated by Party A,and the Defaulting party should pay for the Agency service fee which is equal to the number of rental.】
四、租金及支付方式【Rental and Method of Payment】

4.3 支付方式【Method of Payment】:租金按每个月为一期支付,期租金于起租日以前付
清,以后每期租金支付时间为当月 日之前,先付后用(若乙方以汇款形式支付租金,则汇出日为支付日,汇费由汇出方承担),甲方收到租金后应予以书面签收。
【The payment of rental shall be made every month. The first payment shall be made before lease inception. Each successive payment shall be made by th every month.
Party B shall pay the rental before it moves into the premises. (If Party B pays the rental in
the form of remittance, the date of remitting shall be the day of rental payment. The
remittance fee shall be borne by the remitter.) Party A should issue a written receipt after
each payment of rental is received.】
五、保证金【Deposit of Security】
5.1 为确保房屋及其附属设施之安全与完好及租赁期内相关费用之如期结算,乙方同意支付给甲
方保证金共计人民币 ¥ (大写: 元整)。甲方在收到保证金后应
予以书面签收。
【To ensure that the premises and its accessory facilities are safe and in good condition and that accounts of relevant fees are settled on schedule during the term of lease, Party B agrees
to pay to Party A ¥a deposit of security for fulfilling the Contract. After
receiving the deposit, Party A should issue a written receipt.】
5.2 除合同另有约定之外,甲方应于租赁关系消除且乙方保证原有房屋及设施完好,迁空,点清,
并付清所有应付费用后当天将保证金全额无息退还乙方。
【Unless otherwise agreed upon, the amount of deposit of security shall be refunded by Party
A without interest to Party B upon expiration of the lease, provided that Party B has vacated
the premises, left everything in the premises intact and paid up all expenses due, kept the
premises and all facilities in good condition.】
5.3 因乙方违反本合同的规定,而产生的违约金,损害赔偿金以及应付租金及相关费用,甲方可
经乙方书面确认后在保证金中抵扣,不足部分乙方必须在接到甲方付款通知后十天内补足。
【Any penalty for breach of Contract, compensation for damage and rental and other relevant fees payable arising from Party B’s violation of the provisions of the Contract may be
deducted by Party A from the deposit of security after receiving the written confirmation
from Party B. Any shortage thereof must be made up for by Party B within ten days of the
receipt of the notice of payment issued by Party A.】
5.4 在租赁期内,保证金不可以低用租金。
【The deposit will not be used as monthly rent during the term of lease.】
六、其他费用【Other Fees】
乙方应承担租赁期内的水、电、煤、电信费用等一切因乙方实际使用而产生的费用,并按公
共事业单位的单据如期交纳;土地使用税,房屋维修费 ,物业管理费等原由甲方支付的费用,仍由甲方缴纳。
【Party B shall pay for the water, electricity and gas fees and telecommunication fees and all other fees incurred by Party B in actual use and paid bills from relevant public service
department on schedule during the terms of lease. The ground rent, house maintenance fee
and comprehensive rental tax if necessary and management fee that were originally payable
by Party A still shall be paid by Party A.】
七、甲方的义务【Obligations of Party A】
7.1 甲方须按时将房屋及附属设施(详见合同附件)交付乙方使用, 房屋设施如因质量原因,自
然损害或灾害而受到损坏时,甲方须在三日内安排维修并承担有关的费用,甲方如果不能及时维修,则乙方可以自行安排维修,并从租金中扣除相关维修费用
【Party A shall turn over the premises and accessory facilities (details refer to the appendix) on schedule to Party B for use; Party A shall be responsible for repairing any damage of the premises in three days due to poor quality, natural tear and wear or calamities and bear the expenses thereof;if Part A won’t do it in time, Part B will do it by itself, and will deduct the fees from the rental.】
7.2 甲方应确保其为出租房屋的合法拥有人,按中国法律该房屋可以出租,如在租赁期内,该房
屋发生所有权全部或部分的转移,设定他项物权或其他影响乙方权益的事情时,甲方应保证所有权人,他项权利人或其他影响乙方权益的第三者,能继续遵守本合同所有条款,反之如乙方权益因此而遭受损害,甲方应负赔偿责任。
【Party A shall ensure that Party A is the legal owner of the premises and the premises can be let according to Chinese law. If all or part of the ownership of the premises is transferred, other rights in rem are settled, or any other happening affects the rights and interests of Party
B during the leasehold, Party A should guarantee that the owner, person to the rights in rem or any other third party that affects the rights and interest of Party B continue to abide by all the articles of the Contract. Otherwise, Party A shall be liable for compensating the loss to the rights and interests suffered by Party B there from.】
八、乙方的义务【Obligations of Party B】
8.1 乙方经甲方同意,可在承租用房内进行装修及添置设备。租赁期满后,乙方可将添置的可拆
动的动产部分自行拆运,并保证不影响房屋的完好及清洁使用。
【Party B may, upon approval by Party A, fit up the leased premises and add equipment therein during the leasehold. Upon expiration of the leasehold, Party B may remove the added part of property that is removable, but Party B must ensure that the premises is in good and clean condition for use.】
8.2 未经甲方同意,乙方不得将承租的房屋转租或分租给第三方,并爱护使用租赁的房屋。如因
乙方的过失或过错致使房屋及设施受到损坏,乙方应负赔偿责任。
【Party B shall not transfer or sublet the leased premises without the approval by Party A and shall take good care of the leased premises. Party B shall be liable for compensating for any damage it caused to the premises and facilities resulting from Party B’s fault or negligence.】
8.3 乙方应按本合同的约定合法使用租赁房屋,不得擅自变更使用性质,不应存放危险物品,
如因此发生损害,乙方应承担全部责任。
【Party B shall use the leased premises lawfully according to the provisions of the Contract. Party B shall not arbitrarily change the use of the said premises. No hazardous materials and
goods shall be allowed to be kept in the premises. If any damage is attributable to such use,
Party B shall be fully liable for the damage.】
8.4 如乙方逾期支付租金,则每逾期一日按应付月租金的百分之一向甲方支付滞纳金。如乙方逾
期超过十日,则视为乙方自动退租,构成违约。甲方有权收回房屋,并追究乙方违约责任。
【If Party B delays such rental payment, Party B shall pay penalty to Party A at the rate of 1% of the due rental for each day of delay. If the delay is in excess of 10 days, it shall be deemed
as automatically quitting tenancy, which shall constitute breach of Contract. Then, Party A
shall have the right to recover the leased premises and take actions against Party B for
liabilities of breach of Contract.】
九、合同终止及解除的规定【Termination and Dissolution of the Contract】
9.1 乙方在租赁期满后,如需续租,应提前一个月通知对方,由双方另行协商续租事宜。
【If Party B intends to renew the leasehold upon its expiration, it shall notify Party A of such intention one month prior to the expiration of the lease term. Then, the two parties shall
discuss matters over the renewal of leasehold】
9.2 租赁期满后,乙方应在三日内将承租的房屋及设施在正常状态下交还甲方,如有留置的任何
物品,在未取得甲方的谅解之下,均视为放弃,任凭甲方处置,乙方绝无异议。
【Upon the expiration of the leasehold, Party B shall return the leased premises and accessory facilities in normal condition to Party A within three days. Any belongings left
behind in the house shall, without obtaining previous understanding of Party A, be deemed
as things given up by Party B and shall be disposed of by Party A at its discretion, to which
Party B shall raise no objection.】
9.3 本合同一经双方签章后立即生效,未经双方同意,不得任意终止,如有未尽事宜,甲,乙双
方可另行协商。
【This Contract shall come into force upon the date of being signed by both parties. It must not be terminated at will without the approval of both parties. Anything not covered in the
Contract must be consultanted separately by Party A and Party B.】
十、违约处理【Handling of Breach of Contract】
10.1 甲、乙任何一方如未按本合同的条款履行,导致中途终止本合同,并且过错方在未征得对
方谅解的情况下,则视为违约,双方同意违约金为二个月的租金。若违约金不足弥补无过错
方之损失,则违约方还需就不足部分支付赔偿金。
【If failure of either Party A or Party B to fulfill the articles of the Contract results in the termination of the Contract before its expiration, the Party at fault shall be deemed as violating the Contract without obtaining the understanding of the other Party. The two parties agree that the penalty for breach of Contract shall be two month rental. In case such penalty is not sufficient to make up for the loss suffered by the faultless party, the party that has violated the Contract shall pay additional compensation.】
10.2 凡在执行本合同或与本合同有关的事情时双方发生争议,应首先友好协商,协商不成,提
交上海仲裁委员会仲裁解决,如双方不服,可向有管辖权的人民法院提出诉讼。
【Any dispute arising from the execution of, or in connection with, the Contract shall be settled through friendly negotiation between both parties. In case no settlement can be reached, the disputes shall be submitted to the Shanghai Arbitration Committee, if the settlement still can not be reached by both parties, the disputes can be submitted to the people’s court which has jurisdiction over the premises.】
十一、其他【Others】
11.1 本合同的附件是本合同的有效组成部分,具有同等法律效力。本合同及其附件用中文和英
文书写,二种文本具有同等效力,上述二种文本如有不符,以中文本为准。
【The appendix is an effective component of this Contract, which shall have the same force of law. This agreement and its appendix are written both in Chinese and English, and the two copies are equally authentic. If there is any inconsistency between them, take the Chinese copy in writing separately as the standard.】
11.2 本合同一式三份,甲,乙双方各持一份 ,居间方持一份, 一经双方签章后立即生效。甲、
乙双方如有特殊约定,可在本合同的附件中另行约定。
【This Contract is made in three copies; two for each party and one to be held by Real Estate Agency, and it shall come into force upon the date of being signed by both parties.. If Party
A or Party B has any specific matters, it may be listed in the contract】。
11.3 补充条款 【supplementary clause】
甲方承诺在其出租的上述房屋内及时增添以下设备提供乙方居住使用或其他相关服务,所产
生费用由甲方承担;若由于甲方的原因不能实现,乙方可以从支付给甲方的租金中扣除相应
的设备或服务费用后自行处理,并向甲方出据相应正规票据!(若下列填写文字与合同正文
铅印文字相冲突,以填写文字为准。)
【Party A promise to offer Party B the following list of facilities to use in the rented apartment
and related service, if Party A can’t offer it in time, Party B will do it by himself, and will
deduct the cost from the rental, and offer Party A the official invoice of the facilities.】
